1. Definition

• "RICHESD, "we," "us," "our" and grammatical variants thereof shall collectively refer to RICHESD, a corporation organized and existing under the laws of the Service Tax Department of the State of Karnataka, INDIA, holding a registration number - AWTPP9153EST001, located at  RICHESD BRIGHT SCHOOL's Building, #192/8, Jakasandra, Koramangala, Bangalore - 560034, Karnataka,INDIA.
• "You", "your" and grammatical variants thereof shall mean YOU, any other entity which has an ownership or other beneficial interest in you.
• "RICHESD Services" shall mean the products and services provided by RICHESD, at any given time, that includes web hosting, e-mail, domain registration, templates from RICHESD's Template-Shop, website designing and any associated support services, which services may be changed, amended, and/or otherwise altered at any time in RICHESD's sole discretion.
• "Customer Service" shall refer to communication from us to you dealing with problems or questions relating to services provided by us to you.
• "Technical Support" shall refer to communications from us to you dealing with problems or questions relating to technical matters involving services provided by us to you.
• "Web Space" or "Website Sapce", is the computer memory space, allotted as per the decriptions made in the RICHESD website, to some of the RICHESD Services.
• "Content" shall mean the downloadable files which are interpreted by a client web browser for display with or without plug-ins.
• "Bandwidth" shall refer to the rate of data transmission in bits per second using RICHESD's Equipment.
• "Fee" shall mean monies and other consideration you are obligated to pay to RICHESD for the right to use the RICHED Service(s).
• "Contract Period" the maximum time period (denoted in days, months or years) the RICHESD services can be used form the date of signup or renewal. These are mentioned in the respective services description or related pages, published in the RICHESD website.
• "Fee Schedules" shall mean the fee for RICHESD Servicres & Products, which may be changed at any time in RICHESD's sole discretion.
• "Laws" shall mean the laws, statutes, and regulations then in effect of Karnataka state, INDIA.
• "International Customers" shall mean customers residing in or accessing the RICHESD Services from outside of INDIA.
• "Taxes", the 'service tax' decided as per Government of INDIA, which are applicable for the RICHESD services used by customers residing in INDIA. Taxes are applicable if mentioned in the RICHESD website or quotations.
• "Parties" shall collectively refer to RICHESD and You.
• "Suspend" or "Suspension" shall include the disabling of, releasing of, and/or placing of a registrar lock on your domain name and the cessation of transmission of data to or from Your Web Site or via Your Services.
• "Your Services" is the RICHESD Services(s) which is selected by you.
• "Your Website" is the webpages & contents that are stored in the web space allotted to you by us & the data transmitted by RICHESD equipments. OR "Your Website" can also mean the website designed or maintained by us.

3. Fees & Payments

• Fees for the services offered by RICHESD, has to be paid in advance. All prices are denoted in INDIAN RUPEE (INR), as the services offered by this website is limitted to INDIA only.
• Payments are accepted by Debit/Credit Cards, Bank Transfers, Newt Banking & Mobile Banking Payments which are processed by SKRILL (MONEYBOOKERS), 2Checkout & CCAVENUE.
• Payments are also accepted by bank transfers to our Bank Accounts in INDIA. Any selected Services are activated only upon the amount being credited to our bank accounts.
• Payments are also accepted by check (cheque). Any selected Services are activated only upon the clearance of the check (cheque).
• Payments are also accepted by cash at RICHESD office only. Selected services activation are processed instantly.

4. Refund & Cancellation Policy

• Refund conditions are as follows
  Domains : No refund & cancellation is provided for domain purchases.
  Hosting : Refund is not provided for hosting packages, unless & until it is mentioned in the hosting package or if the account is under trial, if trial period exists. If refund is provided then the package will be terminated from the date of confirmation of refund.
  Templates from Template-Shop : Templates are third party products/services. Refund, exchange or cancellation has to be dealt by replying to the mails that are received after the purchase of the templates.
  Website Designing : No refund or cancellation will be provided for these services.
  Third Party Products/Services : We are not responsible for any such products/services & all have to be dealt directly with the third party.
  Refund by RICHESD if any will all be provided in the same means, as we had received the payments from the client. Refund by cash is not permitted & in such cases the amount will be refunded by the means that will be acceptable by us & the client, the final decisions lying on our side. All refunds are setteled within 48 hours. In some cases if further clarification is required by us or the client, such refunds will be settled within 48 hours after the clarifications. All refunds in any case are settled maximum time not taking more than 30 days from the request date.

5. Warranties by RICHESD

• RICHESD does not provide any warrenty on the products / services provided.

6. Your Obligations

• You agree and warrant that the contact information you have provided to RICHESD is complete and accurate, and you further agree to notify RICHESD within ten days of a change to any such contact information. Contact information includes your full legal name, e-mail address, mailing address, telephone number, facsimile number, and e-mail address of the technical and administrative contacts for your domain, if any.
• You agree and warrant that your use of the RICHESD Services and RICHESD's Equipment, and all sales and distributions, by any and all means, of any type(s) of Content including, but not limited to, executable files (such as .EXE), digitized audio/visual files (such as MP3), or archived copies of copyrighted works (such as .ZIP); goods, including, but not limited to, videotapes and CD-ROM products, and any type of services by you, which are advertised and/or promoted by, or are in any other way directly or indirectly associated with your use of the RICHESD Services or RICHESD Equipment, shall at all times comply with all applicable Laws.
• You agree and warrant that Your Data shall not violate any Laws concerning obscenity and shall not contain or link to any pornography, or depictions of bestiality, rape, sexual assault, violence, torture or disfigurement, or other content deemed objectionable by RICHESD, in its sole discretion.
• You agree and warrant that your usage of RICHESD services are not for advocating, promoting or providing assistance in carrying out violence or any other unlawful activity against any persons, animals or any governments, businesses or other entities.
• You agree and warrant that your usage of RICHESD services are not for describing or displaying a weapon, or parts of weapons, or manuals for assembling any weapon, including but not limited to firearms, ammunition, explosives, grenades, bombs and caustic or other dangerous substances contrary to any laws.
• You agree and warrant that your usage of RICHESD services are not for Promoting products or services that involve a significant risk of death or injury to any persons, or damage to business or other entities or property contrary to any laws.
• You agree that if, in RICHESD's sole and exclusive judgment, RICHESD concludes that Your Web Site displays, contains or links to any harmful matter or indecent materials or communications which are available to, or accessible by, minors, or displays or contains any material that consists of child pornography or which could otherwise result in harm to minors; then RICHESD may, without prior notice to you and in RICHESD's sole and exclusive discretion, either remove and erase the material from Your Web Site, and/or disable public access to the material on Your Web Site, and/or cease hosting Your Web Site, without any liability of any kind to RICHESD from either you or any third party.
  

7. Term & termination

• Term of this agreement is for one month & will be updated or renewed every month.
• All orders or existing account will be subjected to the updated agreement.
• You can terminate this agreement for any reason with or without cause. This has to notified to RICHESD through e-mail or in writing.
• RICHESD can terminate this agreement:
  • if RICHESD, in its sole discretion, deems that you have breached any part of this Agreement.
  • if payment for RICHESD services is overdue for more than 10 days.
• after termination RICHESD services are not avaliable. You will not have access to your account, data & will not have data transmitted through RICHESD equipments. If the termination is due to non paymnet of dues, then reactivation will cost 10% extra on the due amount, minimum being $5 (USD) & maximum not exceeding $10 (USD).

8. No Assignment by You. Assignment by RICHESD

• This Agreement and the rights pertaining hereto may not be assigned, resold, or otherwise transferred in whole or in part by you without RICHESD's prior written consent. In particular, you may not sell accounts or subaccounts to third parties. Notwithstanding the above, this agreement shall be binding upon your successors and assigns, if any. RICHESD may assign or license any or all of its rights and/or obligations hereunder in its free, sole, and unfettered discretion.

9. Notices

• RICHESD may provide notice to you via e-mail sent to the e-mail address provided by you upon registration or as subsequently provided by you to RICHESD. Such notice is deemed effective whether you receive it or not and shall be deemed written notice for the purposes of this Agreement.
• You may provide notice to RICHESD in one of the following ways:
  • by personal delivery
  • by addressing the notice as indicated below and depositing the same by registered or certified mail, postage prepaid, in the INDIAN mail, RICHESD, RICHESD BRIGHT SCHOOL's Building, #192/8, Jakasandra, Koramangala, Bangalore - 560034, Karnataka,INDIA.
  • by courier services
  • by e-mail and registered or certified mail
• Such notice, statement or other document so delivered to RICHESD, except as this Agreement expressly provides otherwise, shall be conclusively deemed to have been given when first personally delivered, on the date of delivery or on the first date of receipt. Notice by e-mail to RICHESD shall be deemed ineffective, null and void unless a copy of such notice is also sent by registered or certified mail, and postmarked not more than five days subsequent to the giving of e-mail notice. Any such e-mail notice to RICHESD shall be deemed effective as of the date on which RICHESD receives the certified or registered mail notice.

10. Arbitration

• Any & all disputes as to the interpretation of or performance under this Agreement which are not first resolved informally, shall be determined binding arbitration in Bangalore, Karnataka in accordance with the rules / law enforced in & by State of Karnataka.

11. Modifications

• This Agreement may be materially altered by RICHESD by posting the new version of the Agreement at www.RICHESD.com and if posted in this manner, shall be effective immediately upon posting such notice. In the event that RICHESD does materially change the terms of this Agreement, you accept and shall be bound by such changed terms unless you opt to terminate the Agreement.

12. Status of Limitations

• You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or this Agreement must be filed within one year after such claim or cause of action arose or be forever barred.

13. Entire Agreement

• This Agreement constitutes the entire agreement of the Parties with respect to the subject matter hereof, and supersedes and cancels all other prior agreements, discussion, or representations, whether written or oral. No officer, employee or representative of RICHESD or you has any authority to make any representation or promise in connection with this Agreement or the subject matter thereof which is not contained expressly in this Agreement, and RICHESD and you hereby acknowledge and agree that neither RICHESD nor you have executed this Agreement in reliance upon any such representation or promise.
